Alan Dershowitz, the high-profile attorney and law professor who just joined President Donald Trump’s defense team, made the case against impeachment on Sunday by focusing only on constitutional requirements.
On ABC’s “Today,” Dershowitz stated the two posts of impeachment– abuse of power and obstruction of Congress coming from the pressure project on Ukraine to examine a Trump political competitor– were “noncriminal actions.”
” When you check out the text of the Constitution, treason, bribery, other high criminal activities and misdemeanors– ‘other’ actually indicates that criminal activities and misdemeanors need to be … similar to treason and bribery,” he said.
The program’s host, George Stephanopoulos, pressed him on the point: “Is it your position that President Trump should not be impeached even if all the evidence and arguments set out by the Home are accepted as reality?”
” That’s right,” Dershowitz responded. Invoking the creators Alexander Hamilton and James Madison, he kept that impeaching based upon the existing posts might lead to “headache” situations, offering Congress too much power over the president or turning impeachment into a concern of “who has the most votes in your home.”
In an earlier interview with ABC, the chairman of your home Intelligence Committee, Rep. Adam Schiff (D-Calif.), dismissed that argument as “absurdist.”
” You needed to go so far out of the mainstream to discover somebody to make that argument,” Schiff said Sunday. “You needed to leave the world of constitutional law scholars and go to criminal defense legal representatives.”
Dershowitz stated he was comfy with his position, saying: “The argument is a strong one, the Senate should hear it. I am privileged to be able to make it.” Besides, he stated, it’s an argument that was successful in the impeachment trial of President Andrew Johnson in 1868.
Dershowitz calls himself a “liberal Democrat,” and states he elected the 2016 Democratic nominee, Hillary Clinton, over Trump. He has also attempted to minimize his function on Trump’s defense team, insisting he isn’t a “full-fledged” member.
” I’m not here for a political discussion,” he stated on Sunday.

In his current book on impeachment, Dershowitz composed that “an American must not conspire with a foreign power in an effort to improve his candidateship.” However on Sunday, Dershowitz would not comment on whether he concurred with the Trump legal team’s quick.
” I didn’t sign that short. I didn’t even see the quick till after it was filed,” he stated. “That’s not part of my mandate. My required is to determine what is a constitutionally authorized requirements for impeachment.”
” If the claims are not impeachable, then this trial should result in an acquittal,” Dershowitz said, “despite whether the conduct is considered as OK by you or by me or by voters.”
